East Gwillimbury College – Student Protal.is committed to respecting the privacy concerns of its visitors to www.egcollege.ca (the “Website”).

We have created this privacy policy (the “Privacy Policy”) to establish guidelines that will govern the collection, use, protection and disclosure of the personal and non-personal information of visitors (“You” or “Visitor”) to the Website.
We value the trust of the Visitor and recognize that maintaining this trust requires that We be open and accountable in our treatment of the Personal Information that You choose to share with East Gwillimbury College.

East Gwillimbury College collects three kinds of information from this Website:
1. Voluntarily provided personal information;
2. Anonymous non-personal information;

PERSONAL INFORMATION
East Gwillimbury College does not automatically collect personal information, such as name, address, phone number, email address and other personally identifiable information, from its Visitors (“Personal Information”).

From time to time, East Gwillimbury College will collect Personal Information that is voluntarily provided by a Visitor when filling out an online form and/or subscribing to newsletters and other activities carried out on the Website.

We keep the Personal Information that You provide to East Gwillimbury College in strict confidence.

We limit the collection of Personal Information to that which is necessary for the purposes identified.
East Gwillimbury College may use email addresses that have been voluntarily provided by its Visitors to respond to Visitors who communicate with East Gwillimbury College. All emails from East Gwillimbury College to its Visitors include instructions on how to discontinue receipt of emails, newsletters and other communication from East Gwillimbury College and Visitors can discontinue such communication at any time. Email addresses from Visitors who wish to discontinue receipt of East Gwillimbury College’s emails will be removed from East Gwillimbury College’s distribution list and databases.

All Personal Information that may identify a Visitor and has been collected with the Visitor’s consent by East Gwillimbury College is not disclosed in any identifiable form to any other party outside East Gwillimbury College, except as required by law, and for the fulfillment of the specific purpose identified to the Visitor at the time of collection.

However, East Gwillimbury College may disclose such information in anonymous, aggregated and non-personally identifiable form to other parties for marketing, advertising or other purposes and to better understand Visitor’s use of the Website.

At any time, a Visitor may send an email to East Gwillimbury College to request that Personal Information be changed, removed or updated in FCC’s databases.

PAYMENTS
The Website contains a link to an online form that allows a Visitor to make a payment. The personal and credit card information provided on this form is used only to process the payments. Online payments to East Gwillimbury College may be processed through a third party. The security and privacy policies of this third party are available by clicking on the relevant “Privacy Policy” link on the online payments form web page.

ANONYMOUS NON-PERSONAL INFORMATION
When a Visitor visits the Website, anonymous, non-personal information about their visit is automatically collected. Access to Personal Information collected by East Gwillimbury College is limited to authorized individuals and stored on its databases, which are protected by firewalls and are password-secured. SEXUAL VIOLENCE AND MISCONDUCT POLICY FOR EAST GWILLIMBURY COLLEGE

1) Sexual Violence and Misconduct Policy

  • a) East Gwillimbury College is committed to providing its students with an educational environment free from sexual violence or misconduct and treating its students who report incidents of sexual violence or misconduct with dignity and respect.
  • b) East Gwillimbury College has adopted this Sexual Violence and Misconduct Policy, which defines sexual violence and misconduct and outlines its training, reporting, investigative and disciplinary responses to complaints of sexual violence and misconduct made by its students that have occurred on its campus.
  • c) The person accused of engaging in sexual violence or misconduct will be referred to as the “Respondent” and the person making the allegation as the “Complainant”.

 

2) Definition of Sexual Violence and Misconduct

Sexual violence means any sexual act or act targeting a person’s sexuality, gender identity or gender expression, whether the act is physical or psychological in nature, that is committed, threatened, or attempted against a person without the person’s consent, and includes sexual assault, sexual harassment, stalking, indecent exposure, voyeurism, and sexual exploitation.

3) Training, Reporting and Responding to Sexual Violence or Misconduct

  • a) East Gwillimbury College shall include a copy of the Sexual Violence and Misconduct Policy in every contract made between it and its students, and provide a copy of the Sexual Violence and Misconduct Policy to career college management, instructors, staff, other employees and contractors and train them about the policy and its processes of reporting, investigating and responding to complaints of Sexual Violence and Misconduct involving its students.

* Any company participating in offering student internships on their premises must provide an undertaking in writing that it is in compliance with all applicable legislation, including, but not limited to, the BC Sexual Violence and Misconduct Policy Act and will provide students access to those policies should they encounter issues relating to sexual violence or misconduct in the workplace.

  • b) The Sexual Violence and Misconduct Policy shall be published on its website.
  • c) Career college management, instructors, staff, other employees and contractors of East Gwillimbury College will report incidents of or complaints of sexual violence and misconduct to the Campus Director
  • d) Students who have been affected by Sexual Violence and Misconduct or who need information about support services should contact the Campus Director.
  • e) Subject to Section 4 below, to the extent it is possible, East Gwillimbury College will attempt to keep all personal information of persons involved in the investigation confidential except in those circumstances where it believes an individual is at imminent risk of self harm, or of harming another, or there are reasonable grounds to believe that others on its campus or the broader community are at risk.
  • f) East Gwillimbury College recognizes the right of the Complainant not to report an incident of or make a complaint about Sexual Violence or Misconduct or not request an investigation and not to participate in any investigation that may occur.
  • g) Notwithstanding , in certain circumstances, East Gwillimbury College may be required by law or its internal policies to initiate an internal investigation and/or inform police without the complainant’s consent if it believes the safety of members of its campus or the broader community is at risk.
  • h) In all cases, including
  • f) above, East Gwillimbury College will appropriately accommodate the needs of its students who are affected by sexual violence or misconduct. Students seeking accommodation should contact the Campus Director. In this regard, East Gwillimbury College will assist students who have experienced sexual violence or misconduct in obtaining counselling and medical care, and provide them with information about Sexual Violence and Misconduct supports and services available in the community as set out in Appendix 1 attached hereto. Students are not required to file a formal complaint in order to access supports and services.

 

 4) Investigating Reports of Sexual Violence and Misconduct

  • a) Under this Sexual Violence and Misconduct Policy, any student of East Gwillimbury College college may file a report of an incident or a complaint to the Campus Director in writing. The other officials, offices or departments that will be involved in the investigation are Director of Operations, School Director and/or The President.
  • b) Upon receipt of a report of an incident or a complaint of alleged sexual violence and misconduct being made, the Campus Director will respond promptly and: i) determine whether an investigation should proceed and if the Complainant wishes to participate in an investigation; ii) determine who should conduct the investigation having regard to the seriousness of the allegation and the parties involved; iii) determine whether the incident should be referred immediately to the police; In such cases or where civil proceedings are commenced in respect of allegations of sexual violence and misconduct, East Gwillimbury College may conduct its own independent investigation and make its own determination in accordance with its own policies and procedures; iv) and determine what interim measures ought to be put in place pending the investigation process such as removal of the Respondent or seeking alternate methods of providing necessary course studies.
  • c) Once an investigation is initiated, the following will occur: i) the Complainant and the Respondent will be advised that they may ask another person to be present throughout the investigation; ii) interviewing the Complainant to ensure a complete understanding of the allegation and gathering additional information that may not have been included in the written complaint such as the date and time of the incident, the persons involved, the names of any person who witnessed the incident and a complete description of what occurred iii) informing and interviewing the Respondent of the complaint, providing details of the allegations and giving the Respondent an opportunity to respond to those allegations and to provide any witnesses the Respondent feels are essential to the investigation; iv) interviewing any person involved or who has, or may have, knowledge of the incident and any identified witnesses; v) providing reasonable updates to the Complainant and the Respondent about the status of the investigation; and vi) following the investigation, the Campus Director will: (A) review all of the evidence collected during the investigation; (B) determine whether sexual violence and misconduct occurred; and if so (C) determine what disciplinary action, if any, should be taken as set out in Section 5 below.

 

 5) Disciplinary Measures

  • a) If it is determined by East Gwillimbury College that the Respondent did engage in sexual violence or misconduct, immediate disciplinary or corrective action will be taken. This may include: i) disciplinary action up to and including termination of employment of instructors or staff; or ii) expulsion of a student; and/or iii) the placement of certain restrictions on the Respondent’s ability to access certain premises or facilities; and/or iv) any other actions that may be appropriate in the circumstances.

6) Support

East Gwillimbury College of Business, Health and Technology recognizes that sexual violence can have serious and lasting impacts on the physical, mental, and emotional welfare of individuals who are affected by Sexual Violence. East Gwillimbury College of Business, Health and Technology will ensure that the Victim/Survivor is informed about on and off campus resources and support and will respect the right of a Victim/Survivor to decide whether or not to access available services and to choose those services the Victim/Survivor feels will be most beneficial. Management will investigate and deal with all concerns, complaints, or incidents of violence in a fair and timely manner while respecting staff and student privacy as much as possible. Feedback will be provided. The policy is implemented and maintained for staff and students through the orientation to the East Gwillimbury College of Business, Health and Technology. Campus. All staff and students will have the appropriate information and instruction to protect them from violence in the Workplace/Learning Environment.

7) Appeal

  • a) Should the Complainant or the Respondent not agree with the decision resulting from the investigation, he or she may appeal the decision to the President within 10 days by submitting a letter addressed to the President advising of the person’s intent to appeal the decision. A report is the sharing of information concerning an incident of sexual violence by a Victim/Survivor with the intention of initiating a formal process. A disclosure is the sharing of information by a Victim/Survivor concerning an incident of sexual violence. A disclosure may or may not be for the purpose of accessing supports, services and / or accommodations. A disclosure can be made to any University staff of East Gwillimbury College of Business, Health and Technology. A disclosure may relate to a respondent who is or is not at East Gwillimbury College of Business, Health and Technology. Upon receiving a disclosure of sexual violence, East Gwillimbury College of Business, Health and Technology has a responsibility to ensure that an individual affected by sexual violence, is informed of this Policy. Where the Respondent is not a student or staff of East Gwillimbury College of Business, Health and Technology, the matter shall be referred to the Police who will determine any required action necessary (such as a trespass order).

8) Making False Statements

  • a) It is a violation of this Sexual Violence and Misconduct Policy for anyone to knowingly make a false complaint of Sexual Violence and Misconduct or to provide false information about a complaint.
  • b) Individuals who violate this Sexual Violence and Misconduct Policy are subject to disciplinary and/ or corrective action up to and including termination of employment of instructors or staff or expulsion of a student.

9) Reprisal

  • a) It is a violation of this Sexual Violence and Misconduct Policy to retaliate or threaten to retaliate against a complainant who has brought forward a complaint of Sexual Violence or Misconduct, provided information related to a complaint, or otherwise been involved in the complaint investigation process.
  • b) Individuals who violate the Sexual Violence and Misconduct Policy are subject to disciplinary and/or corrective action, up to and including termination of employment of instructors or staff or expulsion of a student.

10) Review

  • a) East Gwillimbury College shall ensure that student input is considered in the development of its Sexual Violence and Misconduct Policy and every time it is reviewed or amended. b) East Gwillimbury College shall review its Sexual Violence and Misconduct Policy every 3 years after it is first implemented and amend it where appropriate. The next date for review date is January 1, 2024.

11) Staff and Students are encouraged to report any incidents of sexual violence or raise concerns.

STUDENT COMPLAINT/GRIEVANCE PROCEDURE

East Gwillimbury College of Business, Health & Technology is committed to the prompt and equitable resolution of student conflict issues to the satisfaction of both the student and the school. The Student Complaint Procedure is designed to provide students with both an informal and formal process whereby a student may request the review and resolution of a concern if satisfactory resolution has not been reached by way of the daily problem-solving activities between staff and students which, in most cases, result in immediate resolution. The student has the right to present his/her case orally and be accompanied by an individual of his/her choice at all times during the process.  The person referred to as “individual” has the right to make oral submissions on his/her behalf.

Students are encouraged to address any concerns immediately; please do not let a minor problem develops into a major one. Should you have any problems or concerns during your training period, we encourage you to discuss them promptly with the staff member directly involved. Should the resolution to your issue require further involvement, the staff member will arrange a meeting with the appropriate personnel, up to and including the Campus Director.

Formal Procedure

  1. In the case where a student is unable to achieve a satisfactory resolution using the informal direct discussion approach recommended above, the student can submit a written request that a more formal complaint procedure be launched. To do so, a student must complete and sign a Student Complaint Form, recording the concern and documenting the student’s desired resolution. Once signed, a copy of the form is submitted to the Campus Director; the student keeps the original.

 

  1. The Campus Director will arrange to meet with the student normally within two working days of the date of the written complaint. If, as a result of that meeting, the student and the Campus Director decide to implement a mutually agreed to complaint resolution plan, then that decision, the reason for the decision, and a description of the resolution plan must be recorded by the Campus Director in Part B on the student’s original complaint form. The original form must be co-signed by the student and the staff member in sub-section (i) of Part B of the form.   The original must be returned to the student and a copy must be filed in a central Complaints binder.  The documents will be maintained for 3 years.

 

  1. If the student and the Campus Director reach a mutually agreed to resolution in step 2 above then the plan must be implemented and the Campus Director must follow up to ensure the resolution plan satisfactorily resolves the concern. Upon mutually satisfactory resolution of the student concern, the Campus Director will meet briefly with the student to close the concern and record confirmation that the concern has been satisfactorily resolved. The student and the Campus Director will sign the declaration.

Review Process

 

  1. Where a student concern has arisen that could not be resolved to the student’s satisfaction, through the formal procedure outlined above, the student may initiate an appeal.  The student must complete a (Request for a Review) setting out the reasons why the formal procedure resolution was unsatisfactory.  The student will again keep the original form and a copy will be submitted to the Campus Director.
  2. The Campus Director will investigate the student’s concern and meet with the student normally within two (2) working days of the request for a review to discuss resolution. If the Director and the student are unable to resolve the issue the Director shall and/or the student shall refer the complaint to the Designated Student Relations office for review.
  3. Once the Designated Student Relations Office receives a request for review in writing, that office shall conduct an investigation and review the complaint. The National Office shall provide the student and the Campus Director its conclusions/decision, ordinarily within 10 days of the student complaint being referred to the National Student Relations Office. The decision shall include reasons for arriving at that decision.
  4. The student will be given the original signed copy of the student complaint form. The original must be returned to the student and a copy must be filed in a central Complaints binder that will be kept for 3 years.
  5. The Campus Director will maintain this binder on site for possible annual inspection.
  6. If you are not satisfied with the resolution of your complaint, you may submit your complaint to the Superintendent of Private Career Colleges through PARIS, the new automated system. First, please go to this website: https://www.pcc.tcu.gov.on.ca/PARISExtWeb/public/login.xhtml A guide for creating a student user account is available. You will need to Register as a new PARIS user input your contact information and answer security questions. Once you have completed this process, an email will be sent to you at the email address you submitted with a temporary password. Please log in to PARIS and change the temporary password to a permanent one. Once you have gained access to PARIS, you will be prompted for your contact information to ensure that we can get back to you. At that time, PARIS will confirm that you have completed the student complaint procedure at the private career college you are attending. If you haven’t, you will need to do so before the ministry can address your concerns. If you have completed the complaint procedure at the campus level, PARIS will move you forward and will prompt you to fill in information about the private career college you attended, the program and will give you space to describe your complaint and upload supporting documents. These documents are: 1) Student Contract 2) Written complaint submitted to the private career college 3) Submissions made to the private career college as part of the complaint 4) Written decision provided to you by the private career college as part of the student complaint procedure 5) Proof of Payment for your tuition Once you sign the declaration and consent, you will be able to submit your complaint and you will be contacted by an inspector who will review the documents and advise you on next steps.

STUDENT COMPLAINT/GRIEVANCE PROCEDURE

East Gwillimbury of Business, Health & Technology is registered as a private career college under the Private Career Colleges Act, 2005 and therefore must have a procedure and operational plan for handling student complaints. If a student feels that the school has not adequately addressed a complaint or concern, the student may consider contacting the Superintendent at the Ministry. All complaints considered by the Ministry must be in written form, with permission from the complainant(s) for the Ministry to forward a copy of the complaint to the school for a response. The complainant(s) will be kept informed as to the status of the complaint as well as the final resolution by the Ministry.

No student complaints will be heard by the Ministry until all procedures listed have been adhered to and then and only then should you direct inquiries to the:

STUDENT EXPULSION POLICY

Students wishing to withdraw must personally notify the Campus Director and must submit a formal letter of withdrawal. In addition to submitting the required notification, a meeting will be scheduled with the Campus Director, or designate to finalize the student’s records.

This process assures the student that all records are correct and that he or she has, or will, receive all services available from East Gwillimbury College of Business, Health & Technology to ensure a safe and smooth discharge.

Failure to withdraw properly or complete the required exit interviews may result in the assignment of failing grades which then becomes a part of the student’s permanent record.  It is imperative that each student wishing to withdraw or being expelled settles their account as per the colleges refund policy prior to the withdrawal or expulsion.  Failure to do so will be considered non-compliance and the account will be forwarded after 45 days to a collection agency.

East Gwillimbury College of Business, Health & Technology is committed to taking all reasonable steps to ensure the students have the opportunity to successfully complete their programs.  East Gwillimbury College of Business, Health & Technology has a commitment to ensure that within this general framework that all students are treated fairly and equitably.  Students who do not support the academic and ethical goals of the College for themselves and their fellow students may be subject to penalties, up to and including expulsion.

In general, the College will attempt to resolve a situation without expulsion.  Verbal warning, written warnings and suspension may precede this final and most serious of actions.  Where the College deems the integrity, safety or well-being of the College, students, staff, clients, visitors and other guests is in danger then expulsion may be applied at the College’s discretion at any point in the process.

In conjunction with this policy, the college will have to ensure that students receive and are aware of its code of conduct, its academic policy, and its attendance policy.

The following outlines the conditions under which a student may be expelled with cause:

  1. Academic Dishonesty – students may be subject to expulsion at the discretion of the College for academic dishonesty.  Academic dishonesty is any word, action or deed performed alone, or with others for the direct or indirect intention of providing an unfair advantage or benefit to self or other student(s) including:
    • cheating
    • plagiarism
    • unapproved collaboration
    • alteration of records
    • bribery
    • lying
    • misrepresentations
  2. Outstanding Fees – failure to pay overdue accounts owing to the college within the specified period may be grounds for expulsion after a written warning has been given.
  3. Code of Conduct – all students are required to adhere to the College’s published code of conduct.  Where the violations do not have the potential to result in physical harm to persons or property the College may expel a student who has received suspension for failure to comply and has since violated any of the terms of the College’s code of conduct.  Students who are found under the influence of drugs and/or alcohol or carrying weapons will be subject to immediate expulsion.
  4. Significant Omissions or Errors in Admissions Documentation – the College has a responsibility to ensure students have been admitted in accordance with the registration requirements for the program.  Students who knowingly misrepresent their applications are subject to immediate expulsion.
  5. Academic Failure – students who fail to achieve the required academic standing in their programs may be expelled from the program.   The College may at its discretion offer alternatives to a student and these are outlined in the academic policies for the program of study.
  6. Attendance – students who do not achieve the required attendance as stated in the College policy are subject to expulsion.
  7. Harassment or Discrimination – the College does not condone harassment or discrimination of any student, staff, client, or visitor to the College.  Students participating in harassing or discriminatory activities that are racial, sexual, or pertaining to sexual orientation in nature may be subject to immediate suspension depending on the severity of the activity and pending investigation.
    • Any student, who is deemed by the investigation to have engaged in severe harassing or discriminatory activities, may be expelled at the discretion of the college, depending on the severity of the activity.
    • Racial harassment means bothering, threatening, or treating someone unfairly because of their race, colour, ancestry, birthplace, religious belief, ethnic background, citizenship, or language.
    • Sexual harassment means bothering someone by saying or doing unwanted or unwelcome things of a sexual or gender-related nature including touching inappropriately, making offensive jokes about women and men, making sexual suggestions or requests, staring at or making unwelcome comments about one’s body, displaying sexually offensive pictures, or being verbally abusive because of one’s gender.
    • Sexual orientation harassment means treating someone unequally because they are gay, lesbian, heterosexual, bisexual, or living in a same-sex relationship.  This could include making a hurtful comment or action to an individual that is known or ought to be known to be unwelcome, making Homophobic jokes or hints about a person’s sexual orientation or same-sex partnership status, or displaying of disrespectful signs, caricatures, cartoons, or graffiti.
    • In determining what constitutes harassment or discrimination, the College refers to The Ontario Human Rights Code.  Students requiring more specific information may refer to the specific code as posted on the Provincial web site (http://www.ohrc.on.ca/english/code/index.shtml).
  8. Misuse of College Property – College property is for the provision of the College services.  Students who damage, misuse, steal or otherwise use the property in a way that is prohibited may be expelled and required to make restitution.
  9. Endangerment of Staff or Students – The College is committed to the right of all College staff, students, clients and visitors to be safe.   Students who by action or neglect in any way endanger the safety of themselves or others may be expelled.

Prior to expulsion, depending on the severity and nature of the situation, the College may take intermediate steps at its discretion including:

  • verbal warning
  • written warning
  • suspension
  • expulsion

Notification:

Students who are subject to expulsion for any reason will be notified in writing, either hand delivered or by registered mail with return receipt.  The College is not responsible for non-delivery by registered mail if the student has not provided a valid home address where the student currently resides. The notification will contain a description of the basis for expulsion and the effective date.  Expelled students who dispute the facts of the expulsion and wish to appeal must appeal the decision in writing within one week of the notification by following the college’s student complaint procedure provided to the student and by providing sufficient proof to support the complaint.

A student, whose expulsion is upheld after having followed the college’s student complaint and appeal procedure, may file a further appeal through the Complaints process of the Ministry of Training, Colleges and Universities, provided the students are attending a program approved under the Private Career Colleges Act, 2005.

If a student’s appeal is successful and he/she is eventually reinstated as part of the internal college or Ministry appeal processes, then the college will arrange for the student to make up the training time that he/she had missed since the date of expulsion specified in the written notification.

Fees

Settlement of student’s accounts, for students that have been expelled, will be completed under the College’s Fee Refund Policy, using the effective date of expulsion as the final day of attendance in their program of study.

Return of Property

A student who is expelled is responsible for the return of any College property in his/her own possession within 10 days of the expulsion and will be held financially responsible for any property not returned in good condition or as outlined in the student contract.

The policy pertains to the requirements as prescribed under s. 3.15, s.20.13, and s.24.4 of O.Reg. 415/06.
